Terms and conditions of the Gift Card of the Mieczysław Karłowicz Philharmonic in Szczecin for individual clients
I. Definitions
Issuer of the Gift Card – Wydawca Karty Podarunkowej – Mieczysław Karłowicz Philharmonic in Szczecin, ul. Małopolska 48, 70-515 Szczecin, as entered into the register of cultural institutions kept by the City of Szczecin Culture Department under number RIK6/97, NIP (VAT) 851-031-19-73, REGON (CRO) 000280488, referred to herein as the Philharmonic.
Ticket Office and Gift Shop of the Philharmonic – located in the ground floor of the Mieczysław Karłowicz Philharmonic in Szczecin, ul.Małopolska 48, 70-515 Szczecin
Gift Card – a gift coupon in the form of a plastic card, being the equivalent of cash issued to the User, entitling the User to purchase on this basis Merchandise offered at the Ticket Office and Gift Shop of the Philharmonic; The Philharmonic Gift Card has a unique alphanumeric number assigned to the given Card (the number is located on the reverse of the card)
Purchaser – a person purchasing a Philharmonic Gift Card
User – a person bearing a Philharmonic Gift Card
Merchandise – items offered for sale at the Ticket Office and Gift Shop of the Philharmonic, including tickets for concerts and events organized by the Mieczysław Karłowicz Philharmonic in Szczecin and products constituting the Philharmonic’s trade offer available at the Ticket Office and Gift Shop of the issuer.
II. General terms and conditions
These conditions define the general terms of the use of the Mieczysław Karłowicz Philharmonic in Szczecin Gift Card.
The Philharmonic Gift Card can be purchased with the help of a payment instrument accepted by the Philharmonic, but not using another Philharmonic Gift Card.
The issue of a Philharmonic Gift Card does not constitute a sale subject to tax on goods and services within the meaning of applicable tax regulations. The Purchaser at the moment of purchasing the Philharmonic Gift Card shall receive a written receipt as proof of payment which does not constitute a cash register or a VAT invoice.
The nominal values of a Philharmonic Gift Card received in exchange for financial funds are PLN 150, PLN 250 and PLN 350.
The Philharmonic Gift Card may be used at the Ticket Office and Gift Shop of the Philharmonic, and the online store filharmonia.szczecin.pl/sklep, and entitles to Bearer to purchase Merchandise offered by Philharmonic.
The Philharmonic Gift Card is valid until 31/12/2018.
With the expiration of the validity of the Philharmonic Gift Card, it is not subject to renewal and does not authorize making further purchases.
The Philharmonic Gift Card is not a transferable means of payment and cannot be exchanged for cash in whole or in part and is not refundable by the Philharmonic. The above applies also to the situation where the Card is not executed within the validity period.
If the User makes purchases lower than the value of the Philharmonic Gift Card, the Philharmonic does not offer change in cash.
The Philharmonic Gift Card is not refundable.
The Philharmonic Gift Card is not subject to cancellation or blocking, for example if lost. The User is solely responsible for the safety and correct use of the Philharmonic Gift Card. When stolen, lost or damaged, The Philharmonic Gift Card cannot be exchanged for a new one.
III. Terms of execution
The Philharmonic Gift Cards are bearer cards.
The Seller may refuse to execute the Philharmonic Gift Card in the case of:
● expiry of the validity date of the Philharmonic Gift Card,
● damage to the Philharmonic Gift Card to the extent that it is impossible to read the data stored on the card.
In the situation where the value of the purchased product is higher than the nominal value of the Philharmonic Gift Card, the user is obliged to make an additional payment up to the price of the mentioned Merchandise using a financial instrument accepted by the Philharmonic.
The Philharmonic Gift Card can be used for only one transaction.
All complaints related to the use of the Philharmonic Gift Card may be submitted; directly at the Ticket Office and Gift Shop of the Philharmonic during open hours, by mail to the Issuer's address: Mieczysław Karłowicz Philharmonic in Szczecin, ul. Małopolska 48, 70-515 Szczecin, with the note "Philharmonic Gift Card – complaint", or by e-mail to the following address: kasa@filharmonia.szczecin.pl
Complaints about Merchandise subsequently purchased may be submitted on general terms.
Merchandise purchased using the Philharmonic Gift Card are subject to the same rules as to their return, exchange or complaint as apply to normal Merchandise.
The Philharmonic Gift Card is not an electronic payment instrument, nor is it an electronic payment card within the meaning of applicable law. The Philharmonic Gift Card is a form of a gift coupon.
The purchase and/or use of the Philharmonic Gift Card is synonymous with the User’s acceptance of the provisions contained in these Regulations, which is made available when purchasing/issuing the Philharmonic Gift Card and as stated on the Philharmonic website filharmonia.szczecin.pl.
The provisions of the Civil Code shall apply to all matters not regulated in these Terms and Conditions.
The Philharmonic reserves the right to amend the Terms and Conditions for the following important reasons: change of law, valid court judgment, administrative decision, force majeure within the meaning of Polish Civil Code. All changes are effective from the date of their introduction by the Issuer, after making the amended Terms and Conditions available for inspection at the Ticket Office and Gift Shop of the Philharmonic and on the website filharmonia.szczecin.pl.
The Philharmonic is also entitled to change the Terms and Conditions at any time without giving a reason, with the proviso that such a change will not apply to the Philharmonic Gift Cards issued before the date of Terms and Conditions amendment.
These Terms and Conditions come into force on 01/12/2017.
